Chapter 1 General Provisions

Article 1 These Rules are formulated in accordance with the Constitution of the CPC and relevant laws, in combination with the reform of the discipline inspection and supervision system and the practice of supervision and discipline enforcement, in order to strengthen the unified leadership of the Party over discipline inspection and state supervision, strengthen the discipline building of the Party, promote the comprehensive and strict governance of the Party, and standardize the supervision and discipline enforcement work of discipline inspection and supervision organs.

Article 2 Adhere to the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of "Three Represents", the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era. Article 3: Supervision and disciplinary work shall follow the following principles:

Article 4: Adhere to the principle of punishing the past and avoiding the future, treating illness and saving lives, put discipline at the forefront, accurately and effectively use the "four forms" of supervision and discipline, integrate ideological and political work throughout the entire process of supervision and discipline, combine strict management with kindness, give equal importance to incentives and constraints, focus on education and transformation, promote Party members to consciously prevent and correct disciplinary violations, punish a very small number, educate the majority, and achieve the unity of political, disciplinary, and social effects.

Chapter 2 Leadership System

Article 5: The Central Commission for Discipline Inspection shall carry out its work under the leadership of the Party Central Committee. Local disciplinary inspection committees at all levels and grassroots disciplinary inspection committees work under the dual leadership of the same level party committee and the higher-level disciplinary inspection committee.

The Party committee shall regularly listen to and review the work reports of the disciplinary inspection commission and the supervisory commission at the same level, and strengthen the leadership, management, and supervision of the work of the disciplinary inspection commission and the supervisory commission.

Article 6: The disciplinary inspection organs of the Party and the state supervision organs are the specialized organs for self supervision of the Party and the state. The Central Commission for Discipline Inspection and the local commissions for discipline inspection at all levels implement the decisions and arrangements of the Party Central Committee on state supervision work, deliberate and decide on important matters in the lawful performance of their duties, connect disciplinary and law enforcement, and achieve the organic unity of intra party supervision and state supervision.

Article 7: Supervision and disciplinary work shall implement a hierarchical responsibility system:

(1) The Central Commission for Discipline Inspection and the National Supervisory Commission are responsible for supervising, inspecting, and investigating suspected violations of discipline or violations of official duties, as well as crimes committed by central committee members, alternate central committee members, members of the Central Commission for Discipline Inspection, leading cadres under central management, party organizations (party committees) approved by the Party Central Committee, party committees and disciplinary commissions of various provinces, autonomous regions, municipalities directly under the Central Government, and other party organizations.

Local discipline inspection and supervision commissions at all levels shall strengthen supervision over the performance of duties and exercise of power by party committees at the same level in accordance with regulations.

Article 8: Party members, cadres, and supervisory objects suspected of violating discipline and laws whose organizational relationships are at the local level and whose cadre management authority is in the competent department shall be supervised and disciplined according to the principle of whoever is in charge is responsible. The disciplinary inspection and supervision organs established in the competent department and with jurisdiction shall conduct review and investigation. If deemed necessary, the competent department may jointly review and investigate with the local disciplinary inspection and supervision organs. Local disciplinary inspection and supervision agencies, upon receiving problem clues, may conduct a review and investigation in coordination with the competent department, or form a joint review and investigation team with the competent department to promptly report the review and investigation results to the other party.

Article 9: Higher level disciplinary inspection and supervision organs have the right to designate lower level disciplinary inspection and supervision organs to conduct review and investigation of suspected violations of discipline, violations of official duties, or crimes by party organizations, party members, cadres, and supervisory objects under the jurisdiction of other lower level disciplinary inspection and supervision organs. If necessary, they may also directly conduct review and investigation. Superior disciplinary inspection and supervision agencies may designate subordinate disciplinary inspection and supervision agencies to conduct review and investigation of matters directly under their jurisdiction.

If there is a dispute over jurisdictional matters between disciplinary inspection and supervision organs, it shall be determined by their common superior disciplinary inspection and supervision organs; If it is deemed that the matter under its jurisdiction is significant and complex, and needs to be under the jurisdiction of the higher-level disciplinary inspection and supervision organs, it may be submitted to the higher-level disciplinary inspection and supervision organs for jurisdiction.

Article 10: Disciplinary inspection and supervision organs shall strictly implement the system of requesting and reporting. The Central Commission for Discipline Inspection shall regularly report its work to the Central Committee of the Communist Party of China, study major issues related to the overall situation, encounter important problems, make decisions on filing, examination and investigation, and impose disciplinary and administrative sanctions. It shall promptly seek approval and report to the Central Committee of the Communist Party of China, reporting both the results and the process. Special reports should be made on the implementation of important decisions made by the Party Central Committee.

Local disciplinary inspection and supervision organs at all levels shall report important matters such as making decisions on filing, examination and investigation, and imposing disciplinary and administrative sanctions to the party committee at the same level, and report to the higher-level disciplinary inspection and supervision commission. After forming clear opinions, formal written requests shall be made. Important matters should be reported promptly.

Disciplinary inspection and supervision organs shall adhere to democratic centralism. For important issues in the handling of clues, interviews and inquiries, preliminary verification, case review and investigation, case trial, and execution, after collective research, they shall be reported to the relevant and main responsible persons of the disciplinary inspection and supervision organs for approval.

Article 11: Disciplinary inspection and supervision organs shall establish a working mechanism for mutual coordination and restraint in supervision and inspection, examination and investigation, case supervision and management, and case trial. At or above the municipal and prefectural levels, the discipline inspection and supervision commissions shall establish separate departments for supervision, inspection, and investigation. The supervision and inspection departments shall be mainly responsible for contacting regions, departments, and units for daily supervision and inspection, as well as handling clues related to suspected general disciplinary violations. The investigation and review departments shall be mainly responsible for conducting preliminary verification and filing investigations on clues related to suspected serious disciplinary violations, job-related violations, and job-related crimes; The case supervision and management department is responsible for supervising and managing the entire process of supervision, inspection, review, and investigation work, while the case review department is responsible for reviewing and controlling cases that require disciplinary and administrative sanctions.

If disciplinary inspection and supervision agencies need assistance in their work, relevant organizations, agencies, units, and individuals shall provide assistance in accordance with regulations, discipline, and law.

Article 12: The case supervision and management department of the disciplinary inspection and supervision organs shall be responsible for supervising and managing the entire process of disciplinary work, and shall do a good job in clue management, organization and coordination, supervision and inspection, supervision and handling, statistical analysis and other work. The Party conduct and political conduct supervision department should strengthen the comprehensive coordination of Party conduct and political conduct construction, and do a good job in supervising and inspecting, reporting and exposing, and conducting comprehensive analysis.

Chapter 3 Supervision and Inspection

Article 14: The Commission for Discipline Inspection and Supervision (Discipline Inspection and Supervision Group, Discipline Inspection and Supervision Working Committee) shall submit or jointly hold regular special meetings with the Party Committee (Party Group) to listen to special reports on strengthening intra party supervision, comprehensively analyze the political ecology of the regions, departments, and units it contacts, propose opinions and work measures for strengthening and improving, and ensure the organization, implementation, and supervision of inspections.

Article 15: Disciplinary inspection and supervision organs shall strengthen daily supervision of the exercise of power in accordance with the responsibilities of the supervised objects, and understand the ideological, work, style, and living conditions of the supervised objects through various means. If they discover early or biased problems or minor disciplinary violations, they shall promptly hold talks to remind, criticize and educate, order inspections, and give admonitions to improve the pertinence and effectiveness of supervision.

Article 16: Disciplinary inspection and supervision organs shall open up channels for reporting through letters, visits, phone calls, and the internet, establish a reporting platform covering the disciplinary inspection and supervision system, timely accept reports and accusations, and give full play to the supervisory role of party members and the masses.

Article 17: Disciplinary inspection and supervision organs shall establish and improve the anti-corruption archives of party members and leading cadres, which mainly include:

(1) Appointment and dismissal status, personnel file status, and handling of personal matters due to inaccurate reporting;

(2) The problem clues and handling situations transferred from inspection, petition, case supervision and management, as well as other aspects;

(3) Relevant materials generated from conducting interviews, preliminary verification, examination and investigation, as well as other work;

(4) Reply materials on Party conduct and clean governance opinions;

(5) Other materials reflecting the situation of clean governance.

The anti-corruption archives should be dynamically updated.

Article 18: Disciplinary inspection and supervision organs shall do a good job in responding to opinions on Party conduct and clean governance in the selection and appointment of cadres, carefully verify the clues reflecting problems, comprehensively use the results of inspections and other supervision, and strictly control the political, moral, work style, and integrity aspects.

Article 19: Disciplinary inspection and supervision organs shall propose disciplinary inspection or supervision suggestions to relevant party organizations or units for prominent problems discovered during supervision, and supervise and urge rectification through methods such as holding special democratic life meetings and organizing special inspections.

Chapter 4: Handling of Clues

Article 20: Disciplinary inspection and supervision organs shall strengthen the centralized management, classified disposal, and regular cleaning of problem clues. The petition and reporting department is responsible for accepting petitions and reports from party organizations, party members, cadres, and supervisory objects under the management of the same level party committee that are suspected of violating discipline, violating official duties, or committing official crimes. It uniformly receives relevant petitions and reports transferred by disciplinary inspection and supervision organs, dispatched or dispatched agencies, and other units, and transfers them to relevant departments of the agency. It deeply analyzes the petition situation and timely reflects the most concerning, direct, and realistic issues that harm the interests of the masses.

When inspection agencies, audit agencies, administrative law enforcement agencies, judicial agencies, and other units discover clues related to suspected violations of discipline, illegal duties, or crimes, they shall promptly transfer them to the disciplinary inspection and supervision agency's case supervision and management department for unified handling.

If the relevant problem clues discovered by the supervision and inspection department, the examination and investigation department, and the cadre supervision department fall within the scope of acceptance by this department, they shall be submitted to the case supervision and management department for filing; For cases that are not within the scope of our department's acceptance, they will be transferred to the case supervision and management department after approval, and then transferred to the relevant supervision and disciplinary department for handling according to the procedures.

Article 21: Disciplinary inspection and supervision organs shall, based on the overall situation of the regions, departments, and units involved in the problem clues, conduct comprehensive analysis, and dispose of them in four ways: through interview letters, preliminary verification, temporary storage for investigation, and closure.

The disposal of clues shall not be delayed or backlogged. The disposal opinions shall be proposed within one month from the date of receiving the problem clues, and a disposal plan shall be formulated and the approval procedures shall be carried out.

Article 22: Disciplinary inspection and supervision organs shall promptly report to higher-level disciplinary inspection and supervision organs on the problem clues and handling of clues reflecting the same level of party committee members, alternate members, standing committee members of disciplinary inspection commissions, supervisory committee members, as well as the main responsible persons of the areas, departments, and units under their jurisdiction.

Article 23: The case supervision and management department shall implement centralized management, dynamic updates, regular summary and verification of problem clues, propose opinions on sub handling, report to the main person in charge of the disciplinary inspection and supervision organs for approval, and transfer them to the responsible department according to procedures. The responsible department shall designate a dedicated person to manage the problem clues, register them one by one, and establish a management ledger. Each link of clue management and disposal should be signed by the handling personnel and registered for future reference throughout the process.

Article 24: Disciplinary inspection and supervision organs shall, according to work needs, regularly hold special meetings, listen to comprehensive reports on problem clues, conduct analysis and judgment, conduct in-depth research on important reported issues and areas where problems are concentrated, propose disposal requirements, and ensure that each case is settled.

Article 25: The responsible department shall do a good job in handling and archiving clues, with complete and complete archive materials, indicating leadership instructions and the disposal process. The case supervision and management department regularly summarizes and verifies problem clues and disposal situations, reports to the main responsible persons of the disciplinary inspection and supervision organs, and notifies relevant departments.

Chapter 5: Conversations and Inquiries

Article 26 Party committees (party groups) at all levels and disciplinary inspection and supervision organs shall promote the strengthening and standardization of political life within the Party, frequently wield the weapon of criticism and self-criticism, timely conduct talks and reminders, and conduct interviews and inquiries, so as to promote Party members, cadres, and supervision objects to enhance their awareness of the Party and discipline.

Article 27: Disciplinary inspection and supervision organs shall handle problem clues through interview letters, draft interview letters for approval, formulate interview plans and related work plans, and submit them for approval according to procedures. If it is necessary to inquire about the main person in charge of the party committee (party group) at the next level through a conversation letter, it should be approved by the main person in charge of the disciplinary inspection and supervision organ, and if necessary, reported to the main person in charge of the party committee at the same level.

Article 28: The conversation shall be conducted by the relevant person in charge of the disciplinary inspection and supervision organ or the responsible department, and may be accompanied by the relevant person in charge of the party committee (party group) or disciplinary inspection and supervision commission (disciplinary inspection and supervision group, disciplinary inspection and supervision working committee) where the interviewee is located; With approval, the main person in charge of the party committee (party group) where the interviewee is located can also be entrusted to conduct the conversation.

The conversation should be conducted in a place with safety and security conditions. If the disciplinary inspection and supervision organs have a conversation, a transcript of the conversation should be made, and after the conversation, the interviewee may write a written explanation depending on the situation.

Article 29: Disciplinary inspection and supervision organs shall send a letter in the name of the office (department) to the person being reported, and copy their party committee (party group) and the main person in charge of the dispatched disciplinary inspection and supervision group. The respondent shall write explanatory materials within 15 working days after receiving the letter, and the main person in charge of their party committee (party group) shall sign the opinions and send a reply letter.

If the person being questioned is the main person in charge of the Party committee (Party group), or if the explanation given by the person being questioned involves the main person in charge of the Party committee (Party group), they shall directly reply to the disciplinary inspection and supervision organs by letter.

Article 30: The handling department shall write a situation report and disposal opinions within one month after the end of the conversation or receipt of the inquiry reply, and submit them for approval according to the procedures. Take corresponding measures according to different situations:

(1) If the reflection is untrue or there is no evidence to prove the existence of problems, it shall be accepted and settled, and feedback shall be sent to the person being questioned by letter.

(2) For minor issues that do not require disciplinary action, measures such as verbal reminders, criticism and education, orders for inspection, and admonitions will be taken.

(3) If the problem is reflected in a more specific way, but the person being reflected denies it and the reasons for denial are not sufficiently specific, or if it is stated that there are obvious problems, it is generally necessary to have another conversation or inquiry letter; If it is found that the person being reported is suspected of violating discipline, violating official duties, or committing crimes that require disciplinary and legal responsibilities, preliminary verification suggestions should be put forward.

(4) Those who falsely accuse and frame others shall be investigated and dealt with in accordance with regulations, discipline, and the law.

If necessary, spot checks and verifications can be conducted on the explanation of the person's conversation and inquiry.

The materials for conversation and inquiry should be stored in the anti-corruption archives.

Article 31: Party members and cadres who are questioned in the interview letter shall explain the issues raised in the current or previous year's interview letter at the democratic life meeting or organizational life meeting, and clarify the situation of the organization's acceptance and settlement; Those who violate discipline should engage in self-criticism and make a self-criticism.

Chapter 6 Preliminary Verification

Article 32: The Party committee (Party group) and the disciplinary inspection and supervision commission (disciplinary inspection and supervision group) shall carry out preliminary verification work, collect objective evidence, and ensure the authenticity and accuracy of clues suspected of violating discipline, violating official duties, or committing official crimes that are traceable.

Article 33: Disciplinary inspection and supervision organs shall handle problem clues through preliminary verification, formulate work plans, establish verification teams, and perform approval procedures. If the person being verified is the main person in charge of the next level party committee (party group), the disciplinary inspection and supervision organs shall report to the main person in charge of the same level party committee for approval.

Article 34: Upon approval, the verification team may take necessary measures to collect evidence, talk to relevant personnel to understand the situation, request relevant organizations to provide explanations, retrieve personal reports on relevant matters, review and copy documents, accounts, archives and other materials, check the asset situation and relevant information, and conduct appraisal and inspection. The verification team shall temporarily withhold the property voluntarily submitted by the verified person and related personnel.

If it is necessary to take measures such as technical investigation or restriction of exit, the disciplinary inspection and supervision organs shall strictly fulfill the approval procedures and hand them over to the relevant authorities for execution.

Article 35: After the preliminary verification work is completed, the verification team shall prepare a preliminary verification report, listing the basic information of the verified person, the main issues reflected, the basis for handling, the preliminary verification results, any doubts, and handling suggestions. The report shall be signed by all members of the verification team for future reference.

The handling department shall comprehensively analyze and preliminarily verify the situation, and propose disposal suggestions in accordance with the proposed case review and investigation, closure, conversation reminder, temporary storage for investigation, or transfer to relevant party organizations for handling.

The preliminary verification report shall be submitted to the main person in charge of the disciplinary inspection and supervision organ for approval, and if necessary, to the main person in charge of the same level party committee.

Chapter 7 Examination and Investigation

Article 36: The Party committee (Party group) shall, in accordance with its management authority, strengthen the examination, investigation, and disposal of suspected serious violations of discipline, violations of official duties, and crimes by Party members, cadres, and supervisory objects, regularly listen to reports on major cases, strengthen the mechanism construction of anti-corruption coordination institutions, and resolutely, accurately, and orderly punish corruption.

Article 37: After preliminary verification, if the disciplinary inspection and supervision organs need to investigate disciplinary or legal responsibilities for suspected violations of discipline, violations of official duties, or crimes committed by party members, cadres, or supervisory objects, they shall file a case for review and investigation.

For those who apply for approval to file a case, they should have already obtained some facts and evidence of disciplinary violations, job-related violations, and job-related crimes, and have the conditions to conduct examination and investigation.

Article 38: For those who meet the conditions for filing a case, the handling department shall draft a report on the review and investigation of the case, which shall be approved by the main person in charge of the disciplinary inspection and supervision organ, and submitted to the main person in charge of the party committee at the same level for approval, and then the case shall be reviewed and investigated.

The decision to initiate an examination and investigation shall be announced to the person under investigation and reported to the main person in charge of the party committee (party group) where the person under investigation is located.

Article 39: For individuals suspected of serious violations of discipline, violations of official duties, or crimes, the main person in charge of the disciplinary inspection and supervision organs shall preside over a special meeting attended by relevant persons in charge of the disciplinary inspection and supervision organs to study and approve the review and investigation plan.

The relevant person in charge of the disciplinary inspection and supervision authority approves the establishment of a review and investigation team, determines the review and investigation interview plan, external investigation plan, approves important information inquiries, and seized property involved in the case.

The main responsible persons of the supervision, inspection, review and investigation departments organize research and propose review and investigation interview plans, external investigation plans, and disposal suggestions, approve general information inquiries, and supervise the investigation and evidence collection review.

The leader of the review and investigation team shall strictly implement the review and investigation plan and shall not make unauthorized changes; Report the progress of the review and investigation in written form, and seek timely approval in case of important matters.

Article 40: The review and investigation team may, in accordance with the Party Constitution, Party rules, and the Supervision Law, conduct interviews, interrogations, inquiries, detention, inquiries, freezing, searching, retrieval, sealing, seizure (temporary detention, sealing), inspection and appraisal upon approval, and request relevant authorities to take measures such as technical investigation, wanted persons, and restrictions on exit.

The responsible department shall establish a ledger, record the usage measures, and regularly file with the case supervision and management department.

The case supervision and management department shall verify and inspect, regularly summarize the use of important measures, and report to the leaders of the discipline inspection and supervision commission and the higher-level discipline inspection and supervision organs. If violations, discipline violations, and illegal use of measures are found, they shall be handled according to different situations to prevent unauthorized expansion of scope and extension of time limits.

Article 41: If it is necessary to take detention measures against the person under investigation, it shall be carried out in accordance with the Supervision Law, and the unit and family members to which the person belongs shall be notified within 24 hours, and it shall be promptly released to the public. If it is not appropriate to notify or disclose due to the possibility of destroying or falsifying evidence, interfering with witness testimony, or colluding, it shall be reported for approval according to procedures and recorded in the case. After the situation that hinders the investigation disappears, the unit and family members of the detained person should be immediately notified.

Article 42: The examination and investigation work shall be conducted by two or more persons in accordance with regulations, who shall present their credentials and issue written notices in accordance with regulations.

Article 43: After the approval of the investigation plan, the relevant person in charge or department head of the disciplinary inspection and supervision organ shall have a conversation with the investigated person, announce the decision to initiate the investigation, explain the Party's policies and discipline, and require the investigated person to correct their attitude and cooperate with the investigation.

The review and investigation should fully listen to the statements of the investigated person, ensure their diet and rest, provide medical services, and ensure safety. Strictly prohibit the use of means that violate the Party Constitution, Party rules, Party discipline, and national laws. It is strictly forbidden to extract confessions, induce confessions, insult, beat, abuse, corporal punishment, or disguised corporal punishment.

Article 44 During the examination and investigation period, the investigated person shall be referred to as a comrade, and shall be arranged to study the Party Constitution, Party rules, Party discipline, and relevant laws and regulations. Education on ideals, beliefs, and purposes shall be carried out, and through in-depth and meticulous ideological and political work, they shall be prompted to deeply reflect, recognize mistakes, explain problems, and write materials for repentance and reflection.

Article 45: External investigation work must be strictly carried out in accordance with the external investigation plan, and the scope of review and investigation shall not be arbitrarily expanded, the objects and matters of review and investigation shall not be changed. Important matters shall be promptly reported and requested.

During the external investigation period, without approval, the supervisory and disciplinary personnel shall not have individual contact with any personnel involved in the case or their specific related persons, shall not take investigation measures without authorization, and shall not engage in activities unrelated to the external investigation matters.

Article 46: Disciplinary inspection and supervision organs shall strictly collect and identify evidence in accordance with rules, regulations, and laws, achieve comprehensiveness and objectivity, and form a mutually corroborating, complete, and stable chain of evidence.

Investigation and evidence collection should collect the original materials, count and number them one by one, register them on site, and have them signed and stamped by the personnel present. If the original materials are inconvenient to transport, preserve, or it is difficult to obtain the original documents, they can be sealed and photographed or recorded, or copies of the original documents can be retrieved; The conversation should be recorded on site and signed by the interviewee after reading it. Evidence that has been retrieved must be promptly handed over to the review and investigation team for unified custody.

It is strictly prohibited to collect evidence through threats, temptations, deception, and other illegal and disciplinary means; It is strictly prohibited to conceal, damage, tamper with, or forge evidence.

Article 47: The sealing, seizure (temporary detention, sealing), freezing, and transfer of property involved in the case shall strictly follow the approval procedures.

When implementing measures of sealing and impounding (temporary seizure, sealing), the supervisory and disciplinary personnel shall, together with the original property holder or custodian, witness, take photos, register and number them one by one in person, fill out the registration form on site, and have the on-site personnel sign it. Items of unknown value should be promptly identified and sealed for safekeeping.

Disciplinary inspection and supervision organs shall establish dedicated accounts and places, designate specialized personnel to safeguard the involved property, strictly fulfill handover and retrieval procedures, and regularly reconcile and verify accounts. It is strictly prohibited to privately possess or dispose of the involved property and its profits.

Article 48: Important evidence collection work such as examination, investigation, conversation, search, sealing, and seizure (temporary or sealed) of suspected serious violations of discipline or violations of official duties, and official crimes shall be recorded and recorded throughout the entire process, and properly kept and archived in a timely manner. The case supervision and management department shall conduct regular inspections.

Article 49: In the examination and investigation of suspected serious violations of discipline or violations of official duties or crimes, supervisory and disciplinary personnel shall not take the investigated person or other important interviewees away from the designated interview venue without approval and completing relevant procedures. They shall not conduct examination and investigation interviews or other important interviews or inquiries in venues without monitoring equipment, and shall not turn off recording and video equipment during the interview.

Article 50: The main responsible persons and leaders in charge of supervision, inspection, review and investigation departments shall regularly inspect the audio and video recordings, interview transcripts, and registration materials of the involved property during the review and investigation period, and promptly correct and report any problems found.

The relevant responsible persons of the disciplinary inspection and supervision organs shall strengthen the supervision of the entire process of examination and investigation by accessing audio and video recordings.

Article 51: After identifying suspected violations of discipline or violations of official duties, the investigation team shall prepare factual materials, meet with the person under investigation, and listen to opinions. The person under investigation shall sign opinions on the factual materials. If they sign different opinions or refuse to sign opinions, the investigation team shall provide explanations or indicate the situation.

After the review and investigation work is completed, the review and investigation team shall collectively discuss and form a review and investigation report, which shall list the basic information of the person under review and investigation, the sources of problem clues and the basis for the review and investigation, the review and investigation process, the main facts of disciplinary violations or job-related crimes, the attitude and understanding of the person under review and investigation, handling suggestions and party discipline legal basis, and be signed by the leader of the review and investigation team and relevant personnel.

A special report should be prepared on important issues and suggestions discovered during the review and investigation process.

Article 52: The review and investigation report, confession and reflection materials, factual materials on disciplinary violations or job-related crimes, reports on property involved in cases, etc. shall be submitted to the main person in charge of the disciplinary inspection and supervision organs for approval in accordance with procedures, and together with all evidence and procedural materials, shall be submitted for review in accordance with regulations.

The materials generated during the entire review and investigation process should be filed and archived upon completion.

Chapter 8 Trial

Article 53: Disciplinary inspection and supervision organs shall strictly review and control suspected cases of disciplinary violations, illegal activities, or crimes in accordance with regulations and laws, and provide opinions on disciplinary action or punishment, ensuring that the facts are clear, the evidence is conclusive, the nature is accurate, the handling is appropriate, the procedures are complete, and the procedures are compliant.

Disciplinary treatment or punishment must adhere to the principle of democratic centralism, and decisions must be made through collective discussion. No individual or minority is allowed to make decisions or approve them.

Article 54: Adhere to the principle of separating examination and investigation from trial, and examination and investigation personnel shall not participate in the trial. The case review department of the disciplinary inspection and supervision organs shall review and handle cases that are suspected of violating discipline, violating official duties, or committing official crimes, and cases that should be subject to disciplinary action or punishment according to regulations, as well as reconsideration and review cases.

Article 55: The trial work shall be conducted in accordance with the following procedures:

(1) After receiving the examination and investigation report, the case handling department shall accept those that meet the transfer conditions after review. Those that do not meet the transfer conditions may be deferred or not accepted.

(2) For major, complex, and difficult cases, the supervisory, inspection, review, and investigation departments have identified the main facts of violations of discipline, violations of official duties, and crimes, and have put forward biased opinions; If there is a significant difference in the determination of the nature of suspected violations of discipline or violations of official duties or crimes, the case review department may intervene in advance with approval.

(3) After the case review department accepts the case, it shall establish a review team composed of two or more people to comprehensively review the case file materials and provide review opinions.

(4) Adhere to the principle of collective deliberation and form handling opinions on the basis of democratic discussion; Those with significant disputes should be reported in a timely manner, and a decision should be made after reaching a consensus. The case handling department shall, based on the case handling situation, have a conversation with the person under investigation, verify the facts of disciplinary violations, job-related violations, and job-related crimes, listen to defense opinions, and understand relevant situations.

(5) For those whose main facts are unclear or evidence is insufficient, with the approval of the main person in charge of the disciplinary inspection and supervision organs, they shall be returned to the supervision and inspection, examination and investigation departments for re examination and investigation; If it is necessary to supplement and improve the evidence, with the approval of the relevant person in charge of the disciplinary inspection and supervision organ, it shall be returned to the supervision and inspection, examination and investigation department for supplementary examination and investigation.

(6) After the completion of the trial work, a trial report should be formed, which includes the basic information of the investigated person, a brief overview of the review and investigation, facts of violations of discipline, law or duty crimes, disposal of the involved property, opinions of the supervisory and inspection or review and investigation departments, and trial opinions. The trial report should reflect the characteristics of intra party review, identify the nature of the fact of violation of discipline according to the Regulations of the CPC on Disciplinary Punishment, analyze the wrong nature of the investigated person's violation of the Party Constitution and deviation from the nature and purpose of the Party, and reflect their attitude, understanding and ideological transformation process. For those suspected of job-related crimes that require criminal responsibility, a "prosecution opinion letter" should also be formed as an attachment to the trial report.

For those who are punished as members or alternate members of the same level party committee, members of the same level discipline inspection commission, or members of the supervisory commission, communication with the higher-level discipline inspection commission and supervisory commission should be made and a handling opinion should be formed before the review of the same level party committee.

The trial work shall be completed within one month from the date of acceptance, and major and complex cases may be appropriately extended upon approval.

Article 56: After the review report is approved by the main person in charge of the disciplinary inspection and supervision organ, it shall be submitted to the meeting of the Standing Committee of the Discipline Inspection Commission for review. For those that require approval from the same level party committee, opinions from the same level party committee organization department and the party committee (party group) where the investigated person is located should be solicited in the name of the disciplinary inspection and supervision agency office (office) before approval.

After the disciplinary decision is made, the disciplinary inspection and supervision organs shall notify the party committee (party group) where the punished party member is located, copy the organization department of the same level party committee, and announce it to all party members and myself in the grassroots organization of their party within one month in accordance with regulations. The execution of disciplinary decisions shall be reported in a timely manner.

Article 57: If the person under investigation is suspected of committing an official crime, the case supervision and management department shall coordinate the transfer to the judicial organs. For cases where lien measures are taken, the lien measures will be automatically lifted after the People's Procuratorate first detains the suspect.

After the case is transferred to the judicial authorities, the examination and investigation department shall track and understand the handling situation, report any problems in a timely manner, and shall not inquire or interfere with the handling work in violation of regulations.

After the completion of the trial work, other issues and clues involved shall be promptly transferred to the relevant disciplinary inspection and supervision organs for disposal upon approval.

Article 58: The property obtained by the investigated person in violation of rules, regulations, and laws shall be confiscated, ordered to be refunded, or registered for submission in accordance with regulations and laws.

The property obtained from suspected job-related crimes shall be transferred to the judicial authorities along with the case.

For those found not to be illegal gains, they shall be returned in accordance with regulations and laws after the case is concluded, and the signing procedures shall be handled.

Article 59: Appeals against disciplinary decisions shall be accepted by the Party committee (Party group) or disciplinary inspection and supervision organ that approved or decided on the disciplinary action; If reconsideration and re examination are required, they shall be accepted after approval by the relevant person in charge of the disciplinary inspection and supervision organs.

The appeal handling department shall establish a review team to review the original case file, and if necessary, collect evidence. After collective research, the handling opinions shall be proposed and submitted to the relevant responsible persons of the disciplinary inspection and supervision organs for approval or the meeting of the Standing Committee of the Discipline Inspection Commission for deliberation and decision, and a reconsideration and review decision shall be made. The decision should be communicated to the appellant, copied to relevant units, and announced within a certain scope.

Adhere to the separation of reconsideration review and examination review, and personnel responsible for reviewing and reviewing the original case shall not participate in the reconsideration review.

The review and reconsideration work should be completed within three months.

Chapter 9 Supervision and Management

Article 60: Disciplinary inspection and supervision organs shall strictly abide by Party regulations and national laws, exercise their powers with utmost caution, exercise self-restraint with utmost strictness, strengthen self supervision, improve internal control mechanisms, consciously accept Party supervision, social supervision, and mass supervision, ensure that their powers are strictly constrained, and resolutely prevent "darkness under the lamp".

Disciplinary inspection and supervision organs should strengthen their leadership in supervising and enforcing discipline, effectively fulfill their main responsibility for self construction, strictly educate, manage, and supervise, so that disciplinary inspection and supervision cadres can become role models for strictly observing discipline, improving work style, and resisting corruption and degeneration.

Article 61: Disciplinary inspection and supervision organs shall strictly implement the cadre admission system, strictly control political security, and discipline inspection and supervision cadres must be loyal, firm, responsible, law-abiding, honest and upright, and have the basic conditions to fulfill their duties.

Article 62: Disciplinary inspection and supervision organs shall strengthen the political, ideological, and organizational construction of the Party, highlight political functions, and enhance political guidance. If the review and investigation team has more than 3 formal party members, a temporary party branch should be established to strengthen the education, management, and supervision of the members of the review and investigation team, carry out policy and theoretical learning, do a good job in ideological and political work, timely discover problems, criticize and correct them, and play the role of a fighting fortress.

Article 63: Disciplinary inspection and supervision organs shall strengthen the construction of the work style of the cadre team, establish a good image of abiding by laws and regulations, strict discipline, deep work style, solid work, humility and prudence, and upholding discipline impartially. They shall guard against formalism and bureaucracy, guard against privileged thinking, guard against rough speech and bossing, continuously improve their ideological and political level and ability to grasp policies, and build a disciplinary inspection and supervision cadre team that is trusted by the Party and the people.

Article 64: If disciplinary inspection and supervision cadres inquire about the case, inquire about the case, or intervene through persuasion, the trustee shall report to the leader of the examination and investigation team and the main responsible persons of the supervision, inspection, and investigation departments, and register for the record.

If it is found that members of the review and investigation team have unauthorized contact with the person under review and investigation, the persons involved in the case, and their specific related persons, or if there are any communication situations, they should promptly report to the leader of the review and investigation team and the main responsible persons of the supervision and inspection departments, as well as the main responsible persons of the disciplinary inspection and supervision organs, and register for the record.

Article 65: Strictly implement the avoidance system. If the personnel involved in the review, investigation, and trial are close relatives of the person under review or the informant, witnesses in this case, interested parties, or have other circumstances that may affect the fairness of the review, investigation, and trial, they shall not participate in the relevant review, investigation, and trial work and shall actively apply for recusal. The person under review, the informant, and other relevant personnel also have the right to request recusal. The selection of seconded personnel, caregivers, and examination venues shall strictly implement the avoidance system.

Article 66: If the review and investigation team needs to borrow personnel, they shall generally be selected from the review and investigation talent pool, and the disciplinary inspection and supervision organs shall organize departments to handle the procedures, implement one case one loan, and shall not borrow multiple times in a row. Strengthen the management and supervision of seconded personnel, and after the secondment is completed, the review and investigation team shall write an appraisal. Seconded units and party members and cadres shall not interfere with matters such as job adjustment and promotion of seconded personnel.

Article 67: Supervisory and disciplinary personnel shall strictly implement the confidentiality system, control the scope and time of knowledge of examination and investigation work matters, and shall not privately retain, conceal, consult, excerpt, copy, or carry problem clues and case related materials. It is strictly prohibited to disclose the examination and investigation work.

During the work period of the review and investigation team members, they should use dedicated mobile phones, computers, electronic devices, and storage media, implement numbering management, and retrieve them for inspection after the review and investigation work is completed.

The reporting of the case and the transmission of examination and investigation materials should use encrypted facilities, and the carrying of case files should be carried by a dedicated person and vehicle, and the files should not be left alone.

Article 68: After the relevant personnel of the disciplinary inspection and supervision organs leave their posts, they shall comply with the management regulations of the declassification period, strictly fulfill their confidentiality obligations, and shall not disclose relevant secrets.

Supervisory and disciplinary personnel shall not engage in professions related to disciplinary inspection, supervision, and judicial work that may cause conflicts of interest within three years of resignation or retirement.

Article 69: Disciplinary inspection and supervision organs shall conduct talks in a fully controllable manner throughout the process. Conduct risk assessment, medical security, safety precautions, and prepare contingency plans for unexpected events before the conversation; Timely analyze the content of the conversation and changes in the case during the conversation, and if serious violations of official duties or crimes are found, and detention measures are required according to the Supervision Law, detention measures should be taken in a timely manner; Before the end of the conversation, do a good job of ideological work for the interviewee. After the conversation, hand over to relevant units or personnel according to procedures, and do a good job of tracking and follow-up.

Article 70: Establish and improve a safety responsibility system. The main responsible persons of the supervision, inspection, review and investigation departments and the leader of the review and investigation team shall be the first responsible persons for the review and investigation of safety. The review and investigation team shall designate a dedicated person as the safety officer. If the person under investigation has a safety accident, they shall report it to the Central Commission for Discipline Inspection within 24 hours and promptly guide public opinion.

If a serious safety accident occurs, or if there are serious violations of discipline, discipline, and law, the main person in charge of the provincial disciplinary inspection and supervision organs shall make a review to the Central Commission for Discipline Inspection, and be notified and held accountable seriously.

The case supervision and management department shall organize regular inspections and irregular spot checks, report problems in a timely manner, and supervise rectification.

Article 71: Disciplinary inspection and supervision cadres who exceed their authority to contact the party committee (party group) leaders of relevant regions, departments, and units, privately store clues, leak information, violate safety and confidentiality regulations, accept requests, intervene in examination and investigation, use cases for personal gain, handle personal cases, insult, beat, abuse, corporal punishment or disguised corporal punishment of the investigated persons, collect evidence in violation of rules, disciplines and laws, intercept, misappropriate or embezzle privately distributed property involved in the case, accept banquets and property, etc. shall be dealt with seriously in accordance with regulations and discipline; Those suspected of violating official duties or committing official crimes shall be held legally responsible in accordance with the law.

Article 72: If disciplinary inspection and supervision organs fail to fulfill their duties and responsibilities in maintaining discipline in supervisory and disciplinary work, they shall be held seriously accountable.

Article 73: If there is a major mistake in the handling of a case, and disciplinary inspection and supervision cadres are suspected of serious violations of discipline or violations of official duties or crimes, a "double investigation" shall be carried out, and not only shall direct responsibility be pursued, but also the responsibility of relevant leaders shall be seriously pursued.

Establish a quality responsibility system for handling cases, and implement lifelong accountability for those who abuse their power, neglect their duties, and cause serious consequences.

Chapter 10 Supplementary Provisions

Article 74: Party committees, central and state organ working committees of each province (autonomous region, municipality directly under the Central Government) may formulate implementation rules in accordance with these rules and based on their actual work.

The Central Military Commission may formulate relevant regulations in accordance with these rules.

Article 75: In addition to implementing these rules, the disciplinary inspection and supervision teams and commissions dispatched by the Commission for Discipline Inspection and Supervision shall also comply with relevant regulations of the Party Central Committee and the Central Commission for Discipline Inspection.

The disciplinary inspection and supervision institutions of state-owned enterprises and institutions shall implement these rules in accordance with actual conditions.

Article 76: These rules shall be interpreted by the Central Commission for Discipline Inspection.

Article 77: These rules shall come into effect on January 1, 2019. The Working Rules of the Discipline Inspection Organs of the CPC on Supervision of Discipline Enforcement (Trial) issued by the Central Commission for Discipline Inspection on January 15, 2017 shall be repealed at the same time. Any regulations previously issued regarding the supervision and enforcement of disciplinary work by disciplinary inspection and supervision agencies that are inconsistent with these rules shall be implemented in accordance with these rules.
