Regulations of the CPC on Disciplinary Punishment


Part One General Principle


Chapter 1 Guiding ideology, principles, and scope of application


Article 1 These Regulations are formulated in accordance with the Constitution of the CPC in order to maintain the Party Constitution and other intra party laws and regulations, enforce Party discipline, purify the Party organization, safeguard the democratic rights of Party members, educate Party members to abide by discipline and laws, safeguard the unity of the Party, and ensure the implementation of the Party's line, principles, policies, resolutions, and national laws and regulations.


Article 2  The discipline construction of the Party must adhere to the guidance of Marxism Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of the Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era. We must uphold and strengthen the Party's comprehensive leadership, resolutely maintain the core position of General Secretary Xi Jinping as the Party Central Committee and the entire Party, resolutely uphold the authority and centralized unified leadership of the Party Central Committee, implement the general requirements of Party building in the new era and the strategic deployment of comprehensively governing the Party strictly, and comprehensively strengthen the Party's discipline construction.


Article 3  The Party Constitution is the most fundamental internal regulation and the general rule for governing the Party. The discipline of the Party is a set of behavioral rules that all levels of Party organizations and Party members must abide by. Party organizations and members must firmly establish political consciousness, overall situation consciousness, core consciousness, and alignment consciousness, consciously abide by the Party Constitution, strictly implement and maintain Party discipline, consciously accept Party discipline constraints, and model compliance with national laws and regulations.


Article 4 The disciplinary work of the Party shall adhere to the following principles:


(1) Adhere to the principle that the Party must manage the Party and comprehensively govern the Party strictly. Strengthen the education, management, and supervision of Party organizations at all levels and all Party members, put discipline at the forefront, and pay attention to early and small measures, and prevent problems from arising.


(2) All are equal before party discipline. Party organizations and members who violate party discipline must be strictly and fairly disciplined, and no party organization or member who is not bound by discipline is allowed within the party.


(3) Seek truth from facts. The behavior of Party organizations and Party members violating Party discipline should be based on facts, guided by the Party Constitution, other Party regulations, and national laws and regulations, accurately identifying the nature of the violation, distinguishing different situations, and appropriately handling it.


(4) Democratic centralism. The implementation of disciplinary actions against the Party shall be decided through collective discussion by the Party organization in accordance with the prescribed procedures, and no individual or minority is allowed to make decisions or approve them without authorization. The decisions made by higher-level party organizations to deal with party organizations and members who violate party discipline must be implemented by lower level party organizations.


(5) Punish the past and avoid the future, cure the disease and save lives. When dealing with party organizations and members who violate party discipline, a combination of punishment and education should be implemented to achieve a balance between leniency and strictness.


Article 5 Using the "four forms" of supervision and discipline enforcement, regularly conducting criticism and self-criticism, and conducting interviews and inquiries, making "blushing and sweating" the norm; Minor disciplinary actions and organizational adjustments have become the majority of disciplinary violations; Those who receive severe disciplinary actions and significant job adjustments have become a minority; Serious violations of discipline and suspected illegal cases have become extremely rare.


Article 6 This regulation applies to party organizations and party members who violate party discipline and should be held accountable for their actions.


Chapter 2  Violation and disciplinary action


Article 7 Party organizations and party members who violate the Party Constitution and other internal regulations, national laws and regulations, Party and state policies, socialist morality, and harm the interests of the Party, the state, and the people, shall be subject to disciplinary action or punishment in accordance with regulations.


We will focus on investigating and punishing corruption cases that have not been restrained or stopped since the 18th National Congress of the Communist Party of China, with concentrated problem clues and strong public feedback, as well as political and economic issues intertwined, and violations of the spirit of the Central Eight point Regulation.


Article 8 Types of disciplinary actions against party members:


(1) Warning;


(2) Serious warning;


(3) Revoke party positions;


(4) Stay under party observation;


(5) Dismissal from the party.


Article 9 For party organizations that violate party discipline, higher-level party organizations should order them to conduct inspections or issue criticism notices. For party organizations that seriously violate party discipline and cannot be corrected themselves, the higher-level party committee may, after investigation and verification, give:


(1) Reorganization;


(2) Dissolve.


Article 10 Party members shall not be promoted within the Party or recommended to non Party organizations for non Party positions higher than their original positions within one year of receiving a warning or within one and a half years of receiving a serious warning.


Article 11 Revocation of disciplinary action within the party refers to the revocation of the party member's party position that was elected or appointed by the party organization. For those who hold two or more positions within the party, when making disciplinary decisions, the party organization should clarify whether to revoke all their positions or one or several positions. If it is decided to revoke one of their positions, the highest position they held must be revoked. If it is decided to revoke two or more of their positions, they must be revoked sequentially starting from the highest position they hold. For those who hold positions in non party organizations, it is recommended that non party organizations make corresponding arrangements in accordance with regulations.


For those who should be punished with revocation of their party positions but have not held such positions, they should be given a serious warning. Meanwhile, for those who hold positions in non party organizations, it should be recommended that the non party organizations revoke their non party positions.


If a party member is punished by revoking their position within the party or receiving a serious warning in accordance with the provisions of the preceding paragraph, they shall not hold any position within the party or recommend to non party organizations to hold a position equivalent to or higher than their original position within two years.


Article 12 The disciplinary measures for staying in the Party include one-year probation and two-year probation. For party members who have been placed on probation for one year and still do not meet the conditions for restoring their party member rights after the expiration of the probation period, the probation period should be extended by one year. The maximum probationary period for staying in the party shall not exceed two years.


During the period when a party member is under probation, they do not have the right to vote, vote, or be elected. During the probation period, if there is a genuine expression of repentance, their party membership rights will be restored after the expiration of the period; Those who persist in not changing or discover other disciplinary violations that should be punished by the Party shall be expelled from the Party.


Party members are subject to probation within the Party, and their positions within the Party are naturally revoked. For those who hold non party positions, it should be recommended that non party organizations revoke their non party positions. Party members who have been punished with probation within the Party shall not hold positions within the Party or recommend positions equivalent to or higher than their original positions to non Party organizations within two years after the restoration of their Party member rights.


Article 13 Party members who have been expelled from the Party shall not be allowed to rejoin the Party within five years, nor shall they be recommended for non Party positions equivalent to or higher than their original positions. Those who are not allowed to rejoin the Party according to other regulations shall comply with the regulations.


Article 14 If representatives of the Party's congresses at all levels are punished with probation or above (including probation), the Party organization shall terminate their qualifications as representatives.


Article 15 For members of the leadership structure of party organizations who have been reorganized, except for those who should be punished by revoking their party positions or above (including revoking their party positions), they will be naturally dismissed from their positions.


Article 16 For party members in party organizations that have been dissolved, they should be reviewed one by one. Among them, those who meet the requirements for party membership should re register and participate in the new organization to live party life; Those who do not meet the requirements for party membership shall be educated and corrected within a specified period of time. If there is still no change after education, they shall be discouraged or expelled; Those who violate discipline shall be investigated in accordance with regulations.


Chapter 3 Rules for the Application of Disciplinary Actions


Article 17  Any of the following circumstances may result in a lighter or mitigated punishment:


(1) Proactively explaining the issue of disciplinary action that should be taken against oneself;


(2) During the process of organizing verification and filing review, being able to cooperate with the verification and review work and truthfully explain the facts of one's violation of discipline and law;


(3) The issue of reporting accomplices or other individuals who should be subject to disciplinary action or legal investigation, which has been verified to be true after investigation;


(4) Proactively recovering losses, eliminating adverse effects, or effectively preventing harmful outcomes from occurring;


(5) Proactively submitting disciplinary gains;


(6) There are other meritorious performances.


Article 18 According to the special circumstances of the case, the Central Commission for Discipline Inspection may decide or the provincial (ministerial) level Commission for Discipline Inspection (excluding deputy provincial and municipal Commission for Discipline Inspection) may decide and submit it to the Central Commission for Discipline Inspection for approval. Party members who violate discipline may also receive reduced punishment beyond the range of punishment stipulated in these regulations.


Article 19 For party members who violate party discipline, they should be given a warning or a serious warning, but if they fall under any of the circumstances stipulated in Article 17 of these Regulations or have other provisions in the specific provisions of these Regulations, they may be given criticism and education, ordered to inspect, admonished or organized to handle, and exempted from party discipline. Party members who violate discipline shall be exempted from punishment, and a written conclusion shall be made.


Article 20 Any of the following circumstances shall result in a heavier or more severe punishment:


(1) Forcing or inciting others to violate discipline;


(2) Refusing to submit or refund disciplinary gains;


(3) Those who have been punished for violating discipline and should be punished for intentionally violating discipline by the Party;


(4) After being disciplined by the Party for violating discipline, it is discovered that their previous disciplinary behavior should have been punished by the Party;


(5) There are other provisions in this regulation.


Article 21  Mild punishment refers to giving a lighter punishment within the range of punishment that should be imposed for disciplinary violations as stipulated in this regulation.


Severe punishment refers to giving a heavier punishment within the range of punishment that should be imposed for disciplinary violations as stipulated in these regulations.


Article 22 Mitigating punishment refers to giving a one level reduction in punishment beyond the range of punishment that should be imposed for disciplinary violations as stipulated in these regulations.


Aggravated punishment refers to imposing an additional level of punishment beyond the range of punishment that should be imposed for disciplinary violations as stipulated in these regulations.


The provisions of this regulation only apply to disciplinary violations of one level, namely expulsion from the Party, and do not apply to the provisions of the first paragraph that reduce the punishment.


Article 23  一人有本條例規定的兩種以上(含兩種)應當受到黨紀處分的違紀行為,應當合并處理,按其數種違紀行為中應當受到的最高處分加重一檔給予處分;其中一種違紀行為應當受到開除黨籍處分的,應當給予開除黨籍處分。


Article 24 If a disciplinary offense violates two or more (including two) provisions of this regulation at the same time, it shall be dealt with qualitatively according to the more severe punishment clause.


All the elements of disciplinary violations stipulated in one clause are included in the elements of disciplinary violations stipulated in another clause. If the special provisions are inconsistent with the general provisions, the special provisions shall apply.


Article 25 If two or more individuals (including two individuals) intentionally violate discipline together, the leader shall be given a heavier punishment, except as otherwise provided in this regulation; Other members shall be punished according to their roles and responsibilities in the joint violation of discipline.


For those who jointly violate economic regulations, they shall be punished according to the amount of their personal income and the impact they have had. The principal members of the disciplinary group shall be punished according to the total amount of disciplinary violations committed by the group; For other joint violators, if the circumstances are serious, they shall be punished according to the total amount of joint violations.


Those who incite others to violate discipline shall be held accountable for their role in the joint violation of discipline.


Article 26 If the leadership structure of the party organization collectively makes decisions that violate party discipline or commits other violations of party discipline, members with joint intent shall be dealt with as joint disciplinary violations; Members who violate the rules and regulations shall be punished according to their respective roles and responsibilities in the collective violation.


Chapter 4 Disciplinary action against illegal and criminal party members


Article 27 If a party organization discovers during disciplinary review that a party member has committed illegal and suspected criminal acts such as corruption, bribery, abuse of power, dereliction of duty, rent-seeking, interest transfer, favoritism, and waste of state funds, it shall be subject to revocation of party positions, probation within the party, or expulsion from the party.


Article 28 If a party organization discovers during disciplinary review that a party member has engaged in behavior as stipulated by the Criminal Law, which does not constitute a crime but requires accountability for party discipline, or has committed other illegal acts that harm the interests of the party, the state, and the people, a warning or even expulsion from the party shall be given depending on the specific circumstances.


Article 29 If a party organization discovers that a party member seriously violates discipline and is suspected of committing illegal crimes during disciplinary review, it shall, in principle, first make a decision on disciplinary action and impose administrative sanctions in accordance with regulations, and then transfer the case to relevant state organs for legal processing.


Article 30 If a Party member is placed under residential surveillance in accordance with the law or arrested, the Party organization shall, in accordance with its administrative authority, suspend his or her Party member rights such as the right to vote, the right to stand for election, and the right to be elected. If, based on the handling results of the supervisory organ or judicial organ, his or her Party member rights can be restored, they shall be restored in a timely manner.


Article 31 If a party member commits a minor crime and the People's Procuratorate makes a non prosecution decision in accordance with the law, or the People's Court makes a guilty verdict and exempts them from criminal punishment in accordance with the law, they shall be given disciplinary actions such as revocation of their party position, probation within the party, or expulsion from the party.


If a party member commits a crime and is fined unilaterally, they shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 32 If a party member commits a crime and falls under any of the following circumstances, they shall be expelled from the party:


(1) Those who have been sentenced to the principal punishment (including probation) stipulated in the Criminal Law for intentional crimes in accordance with the law;


(2) Depriving political rights unilaterally or additionally;


(3) Those who are sentenced to three years or more (excluding three years) of fixed-term imprisonment according to law for negligent crimes.


Those who are sentenced to fixed-term imprisonment of no more than three years (including three years) or sentenced to public surveillance or detention for negligent crimes shall generally be expelled from the Party. For individuals who may not be expelled from the party, they should refer to the regulations on the approval authority for disciplinary action against party members and apply for approval from the higher-level party organization.


Article 33  If a party member is held criminally responsible in accordance with the law, the party organization shall, based on the effective judgment, ruling, decision and the facts, nature and circumstances determined by the judicial organs, impose disciplinary sanctions on the party in accordance with the provisions of this Regulation. If the party member is a public official, the supervisory organ shall impose corresponding administrative sanctions.


If a party member is subject to government disciplinary or administrative penalties in accordance with the law and should be held accountable for party discipline, the party organization may, based on the facts, nature, and circumstances determined by the effective government disciplinary or administrative penalty decision, verify and impose party disciplinary or organizational sanctions in accordance with regulations.


If a party member violates national laws and regulations, violates the rules and regulations of enterprises, institutions, or other social organizations, and is subject to other disciplinary actions, the party organization shall investigate the party's disciplinary responsibilities. After verifying the facts, nature, and circumstances determined by relevant parties, the party organization shall give disciplinary actions or organize processing in accordance with regulations.


After the party organization makes a disciplinary or organizational decision, if the judicial or administrative organs change the original effective judgment, ruling, decision, etc. in accordance with the law, which affects the original disciplinary or organizational decision, the party organization shall make corresponding adjustments based on the changed effective judgment, ruling, decision, etc.


Chapter 5 other provisions


Article 34 If a probationary party member violates party discipline and the circumstances are relatively minor, and the probationary party member qualification can be retained, the party organization shall criticize and educate them or extend their probationary period; Those with serious circumstances shall have their probationary party membership revoked.


Article 35 Party members who have gone missing after violating discipline should be dealt with according to the situation:


(1) For those who have committed serious violations of discipline and should be expelled from the party, the party organization shall make a decision to expel them from the party;


(2) Except as provided in the preceding paragraph, if the person's whereabouts have been unknown for more than six months, the party organization shall expel them in accordance with the provisions of the party constitution.


Article 36 If a party member who violates discipline dies before the party organization makes a disciplinary decision, or if it is discovered after death that they have committed serious disciplinary violations, and should be expelled from the party, their party membership shall be expelled; For those who should be given disciplinary measures such as probation within the Party (including probation within the Party), a written conclusion of violating Party discipline and corresponding handling shall be made.


Article 37 Classification of responsible personnel for disciplinary violations:


(1) The directly responsible party refers to a party member or party member leading cadre who, within the scope of their duties, fails to perform or improperly performs their duties, and plays a decisive role in causing losses or consequences.


(2) The main leader in charge refers to the party member and leading cadres who, within their scope of responsibilities, fail to perform or improperly perform their duties in the work of their direct supervisor, and are directly responsible for the losses or consequences caused.


(3) Important leaders and responsible persons refer to party members and leading cadres who, within their scope of responsibilities, fail to perform or improperly perform their duties related to the work they are responsible for or participate in decision-making, and bear secondary leadership responsibility for the losses or consequences caused.


The leadership responsible persons referred to in this regulation include the main leadership responsible persons and important leadership responsible persons.


Article 38  The term 'voluntary confession' referred to in these regulations refers to a party member suspected of violating discipline confessing their own issues to the relevant organization before the initial review of the organization, or confessing issues that the organization did not have knowledge of during the initial review and investigation of their issues.


Article 39 Calculating economic losses mainly involves calculating direct economic losses. Direct economic loss refers to the actual value of property damage caused by a direct causal relationship with the violation of discipline.


Article 40 The economic benefits obtained from disciplinary violations shall be confiscated or ordered to be refunded.


For other benefits obtained from disciplinary violations such as positions, professional titles, educational backgrounds, degrees, awards, qualifications, etc., the disciplinary inspection agency handling the case or its superior disciplinary inspection agency shall suggest relevant organizations, departments, and units to correct them in accordance with regulations.


For party members who are dealt with in accordance with the provisions of Article 35 and Article 36 of this Regulation, if it is determined through investigation that they have obtained benefits from committing disciplinary violations, they shall be dealt with in accordance with the provisions of this Article.


Article 41 After the decision on disciplinary action is made, it should be announced to all party members and themselves in the grassroots organization of the party where the disciplined party member is located within one month. If they are members of the leadership team, they should also be announced to the leadership team of the party organization where they are located, and the disciplinary decision materials should be included in the disciplined person's file according to their cadre management authority and organizational relationship; For those who have been punished with revocation of party positions or above (including revocation of party positions), corresponding procedures for changes in position, salary, work, and other related benefits should be completed within one month; If it involves revoking or adjusting their non party positions, it should be recommended that non party organizations promptly revoke or adjust their non party positions. In special circumstances, with the approval of the organization that made or approved the disciplinary decision, the processing period may be appropriately extended. The maximum processing period shall not exceed six months.


Article 42 The authority that implements the disciplinary decision of the Party or the unit where the disciplined Party member is located shall report the implementation of the disciplinary decision to the authority that made or approved the disciplinary decision within six months.


Party members who are dissatisfied with the disciplinary actions taken may file an appeal in accordance with the Party Constitution and relevant regulations.


Article 43 The general provisions of this regulation apply to other party regulations that have provisions for disciplinary action, except for those with special provisions in other party regulations issued or approved by the Central Committee of the Communist Party of China.


Part 2  specific provisions


Chapter 6 Punishment for violations of political discipline


Article 44 Those who do not maintain consistency with the Party Central Committee on major principle issues and have actual remarks, behaviors, or cause adverse consequences shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 45 Those who publicly publish articles, speeches, declarations, statements, etc. that adhere to the bourgeois liberalization stance, oppose the Four Cardinal Principles, and oppose the party's reform and opening up decisions through the internet, radio, television, newspapers, flyers, books, or through lectures, forums, reports, symposiums, etc., shall be expelled from the party.


Those who publish, broadcast, publish, publish the articles, speeches, declarations, statements, etc. listed in the preceding paragraph, or provide convenient conditions for the above-mentioned behaviors, shall be given serious warnings or dismissed from their positions within the Party for those who are directly responsible and those who are responsible for leadership; Those with serious circumstances shall be given disciplinary measures such as probation or expulsion from the Party.


Article 46 Those who engage in any of the following behaviors through the internet, radio, television, newspapers, flyers, books, or through lectures, forums, reports, symposiums, etc., and the circumstances are relatively minor, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Publicly publishing articles, speeches, declarations, statements, etc. that violate the Four Cardinal Principles, distort the Party's reform and opening up decisions, or have other serious political issues;


(2) Deliberating on the major policies of the Party Central Committee and undermining the centralization and unity of the Party;


(3) Those who vilify the image of the Party and the state, or defame or slander Party and state leaders, heroic models, or distort the history of the Party, the People's Republic of China, and the People's Army.


Those who publish, broadcast, publish, or provide convenient conditions for the above-mentioned behaviors shall be given a serious warning or have their party positions revoked for those directly responsible and leaders responsible; Those with serious circumstances shall be given disciplinary measures such as probation or expulsion from the Party.


Article 47 Those who produce, sell, or disseminate any of the contents listed in Articles 45 and 46, including books, periodicals, audiovisual products, electronic reading materials, and online audio and video materials, shall be given a warning or a serious warning if the circumstances are relatively minor; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who privately carry or deliver any of the contents listed in Articles 45 and 46, such as books, audiovisual products, electronic reading materials, etc., into or out of the country, and the circumstances are serious, shall be given a warning or a serious warning; Those with serious circumstances shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 48 Those who organize secret groups or other activities that split the party within the party shall be expelled from the party.


Those who participate in secret groups or other activities that split the party shall be subject to probation or expulsion from the party.


Article 49 Those who engage in non organizational activities such as forming cliques, colluding for personal gain, forming cliques, and cultivating personal power within the party, or who gain political capital through activities such as exchanging interests and creating momentum for themselves, shall be given a serious warning or have their party positions revoked; Those who cause the deterioration of the political ecology in their local area, department, or unit shall be subject to disciplinary measures such as probation or expulsion from the Party.


Article 50 Party members and leading cadres who act recklessly in their own areas of governance or departments under their jurisdiction, engage in factionalism, refuse to implement the major policies determined by the Party Central Committee, and even engage in a different set of activities behind the Party Central Committee, shall be subject to disciplinary actions such as revocation of party positions, probation within the Party, or expulsion from the Party.


Those who fail to implement the decisions and deployments of the Party Central Committee resolutely, discount or make adjustments, and cause adverse political effects or serious consequences, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 51 Those who are disloyal and dishonest to the Party, inconsistent on the surface and secretly, deceive superiors and subordinates, engage in two faced behavior, and act as two faced individuals, with minor circumstances, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 52 Those who create, spread, or spread political rumors that undermine the unity and solidarity of the Party shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those with poor political conduct, anonymous false accusations, intentional framing or creating other rumors, causing damage or adverse effects, shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 53 Those who make decisions or express opinions on major policy issues that should be decided by the Party Central Committee without authorization shall be given serious warnings or dismissed from their positions within the Party for those who are directly responsible and those who are responsible for leadership; Those with serious circumstances shall be given disciplinary measures such as probation or expulsion from the Party.


Article 54 Those who fail to seek approval or report major issues to the organization in accordance with relevant regulations, and the circumstances are relatively serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 55 Those who interfere with inspection work or fail to implement inspection and rectification requirements, and the circumstances are relatively minor, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 56 Those who engage in any of the following behaviors against organizational review shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Collusion, forgery, destruction, transfer, or concealment of evidence;


(2) Preventing others from exposing, reporting, or providing evidence materials;


(3) Protecting accomplices;


(4) Providing false information to the organization and concealing facts;


(5) There are other anti organizational censorship behaviors.

For other participants or those who support the above activities by providing information, materials, property, venues, etc., if the circumstances are relatively minor, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who are coerced into participating without knowing the truth and show repentance after criticism and education may be exempted from punishment or not punished.


Those who participate in other gatherings, marches, demonstrations and other activities without organizational approval, and the circumstances are relatively minor, shall be given a warning or a serious warning; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 58 Those who organize or participate in organizations aimed at opposing the leadership of the Party, opposing the socialist system, or being hostile to the government shall be expelled from the Party for their planners, organizers, and key members.


For other participants, if the circumstances are relatively minor, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 59 Those who organize or participate in secret societies or cult organizations shall be expelled from the Party for their planners, organizers, and key members.


For other participants, if the circumstances are relatively minor, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Participants who do not understand the truth and show repentance after criticism and education may be exempted from punishment or not punished.


Article 60 Those who engage in or participate in stirring up and disrupting ethnic relations, creating incidents, or participating in ethnic separatist activities shall be expelled from the Party for their planners, organizers, and key members.


For other participants, if the circumstances are relatively minor, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who are coerced into participating without knowing the truth and show repentance after criticism and education may be exempted from punishment or not punished.


For other acts that violate the party and state's ethnic policies, if the circumstances are relatively minor, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 6 Those who organize or utilize religious activities to oppose the Party's line, principles, policies, and resolutions, and undermine national unity, shall be expelled from the Party for their planners, organizers, and key members.


Other participants shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who are coerced into participating without knowing the truth and show repentance after criticism and education may be exempted from punishment or not punished.


For other acts that violate the religious policies of the Party and the state, if the circumstances are relatively minor, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 62 For party members who believe in religion, ideological education should be strengthened. If they have not changed despite the help and education of party organizations, they should be persuaded to resign from the party; Those who refuse to give up despite persuasion shall be expelled; Those who participate in inciting activities using religion shall be expelled from the party.


Article 63 Those who organize superstitious activities shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who participate in superstitious activities and cause adverse effects shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Participants who do not understand the truth and show repentance after criticism and education may be exempted from punishment or not punished.


Article 64 Those who organize or utilize clan power to resist the Party and the government, obstruct the implementation of the Party and the state's policies and decision-making arrangements, or undermine the construction of grassroots Party organizations, shall be expelled from the Party for their planners, organizers, and key members.


Other participants shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who are coerced into participating without knowing the truth and show repentance after criticism and education may be exempted from punishment or not punished.


Article 65  Those who apply for political asylum outside the country or in foreign embassies or consulates in China, or flee to foreign embassies or consulates outside the country after violating discipline, shall be expelled from the Party.


Those who publicly publish articles, speeches, declarations, statements, etc. of opposition parties and governments outside the country (territory) shall be dealt with in accordance with the provisions of the preceding paragraph.


Those who intentionally provide convenient conditions for the above-mentioned behavior shall be subject to disciplinary measures such as probation or expulsion from the Party.


Article 66 In foreign-related activities, if their words and actions have a negative impact on politics, damaging the dignity and interests of the Party and the state, they shall be subject to revocation of their Party positions or probation within the Party; Those with serious circumstances shall be expelled from the Party.


Article 67 For those who fail to fulfill their main responsibilities and supervisory responsibilities for strict governance of the Party, or fail to fulfill their main responsibilities and supervisory responsibilities effectively, causing serious damage or adverse effects to the Party organization, the direct responsible persons and leaders shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 68 Party members and leading cadres who fail to report, resist, or fight against erroneous thoughts and behaviors that violate political discipline and rules, and who neglect them, engage in unprincipled unity and harmony, causing adverse effects, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 69 Those who violate the Party's fine traditions and work practices and other Party rules, causing adverse effects in politics, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Chapter 7 Punishment for violations of organizational discipline


Article 70 Those who violate the principle of democratic centralism and commit any of the following acts shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party:


(1) Refusing to implement or changing major decisions made by the party organization without authorization;


(2) Violating the rules of procedure and making decisions on major issues by individuals or a few individuals;


(3) Intentionally evading collective decision-making, making decisions on major issues, appointment and removal of important cadres, arrangement of important projects, and use of large amounts of funds;


(4) Under the guise of collective decision-making, collectively violating regulations.


Article 71 If the lower level party organization refuses to implement or changes the decision of the higher level party organization without authorization, the directly responsible person and the leadership responsible person shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 72 Those who refuse to implement the allocation, transfer, exchange and other decisions of the party organization shall be given a warning, serious warning or revocation of their party positions.


Those who refuse to implement the decisions of the Party organization during special periods or emergency situations shall be subject to disciplinary measures such as probation or expulsion from the Party.


Article 73 Those who engage in any of the following behaviors, with serious circumstances, shall be given a warning or severe warning:


(1) Violating personal reporting regulations and concealing information;


(2) Failing to truthfully explain the problem to the organization during conversations or inquiries;


(3) Not reporting as required or providing inaccurate information about an individual's whereabouts;


(4) Not filling in personal file information truthfully.


Those who tamper with or forge personal file information shall be given a serious warning; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Those who conceal serious mistakes before joining the Party should generally be expelled; For those who perform well after joining the Party, they will be given a serious warning, dismissed from their positions within the Party, or placed on probation within the Party.


Article 74 Party members and leading cadres who violate relevant regulations by organizing or participating in spontaneously established hometown associations, alumni associations, comrades in arms associations, etc., and the circumstances are serious, shall be given a warning, serious warning, or revocation of their party positions.


Article 75 Those who engage in any of the following behaviors shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Engaging in non organizational activities such as canvassing and campaigning in democratic recommendations, democratic evaluations, organizational inspections, and internal party elections;


(2) Engaging in non organizational activities in violation of organizational principles during voting and election activities as stipulated by law, organizing, encouraging, or inducing others to vote or vote;


(3) Engaging in other activities that violate the Party Constitution, other Party regulations, and relevant articles of association during elections.


Those who engage in organized campaigning and bribery, or use public funds for campaigning and bribery, shall be subject to severe or aggravated punishment.


Article 76 In the selection and appointment of cadres, if there are behaviors that violate the regulations of cadre selection and appointment, such as nepotism, exclusion of dissidents, making promises of official titles, intervention through persuasion, seeking official positions, sudden promotion or adjustment of cadres, the directly responsible persons and leaders shall be given warnings or serious warning punishments if the circumstances are relatively minor; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


If personnel negligence and mistakes result in serious consequences, the direct responsible persons and leaders shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 77 Those who conceal or distort the truth in the recruitment, assessment, promotion, professional title evaluation, conscription, and placement of demobilized soldiers, or use their power or influence to violate relevant regulations and seek benefits for themselves or others, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who engage in fraudulent activities to obtain positions, job ranks, professional titles, benefits, qualifications, educational backgrounds, degrees, honors, or other benefits shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 78 Those who infringe upon the voting rights, voting rights, and right to be elected of party members, and the circumstances are relatively serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Those who use coercion, threats, deception, or enticement to obstruct party members from exercising their voting rights, voting rights, and the right to be elected independently shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 79 Those who engage in any of the following behaviors shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Obstructing or suppressing criticism, reporting, or accusations, or privately withholding or destroying materials related to criticism, reporting, or accusations, or intentionally leaking them to others;


(2) Suppressing the defense, defense, testimony, etc. of party members, resulting in adverse consequences;


(3) Suppressing appeals from party members, resulting in adverse consequences, or failing to handle party member appeals in accordance with relevant regulations;


(4) Other acts that infringe upon the rights of party members and result in adverse consequences.


Those who retaliate against critics, informants, accusers, witnesses, and other individuals shall receive severe or aggravated punishment.


If the party organization engages in the above-mentioned behaviors, the directly responsible persons and leaders shall be dealt with in accordance with the provisions of the first paragraph.


Article 80 Those who violate the provisions of the Party Constitution and other Party regulations by using fraudulent or other means to develop individuals who do not meet the requirements for Party membership into Party members, or issuing Party membership identity certificates for non Party members, shall be given a warning or serious warning to the directly responsible persons and leaders; Those with serious circumstances shall be subject to revocation of their party positions.


Those who violate the relevant regulations and procedures for developing party members shall be dealt with in accordance with the provisions of the preceding paragraph for those who are directly responsible and those who are responsible for leadership.


Article 81 Those who violate relevant regulations by obtaining foreign nationality or obtaining permanent residency or long-term residence permits outside the country (territory) shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 82 Those who violate relevant regulations by processing documents for personal travel abroad, travel permits to Hong Kong and Macao, or entering or leaving the country without approval, and the circumstances are relatively minor, shall be given a warning or a serious warning; For those with serious circumstances, they shall be given the punishment of revoking their party positions; Those with serious circumstances shall be given the punishment of staying in the party for probation.


Article 83 Party members who leave the organization without authorization or engage in foreign affairs, confidential, military and other work in overseas institutions or temporary overseas delegations (groups), or violate relevant regulations by contacting and interacting with foreign institutions or personnel, shall be given a warning, serious warning or revocation of their party positions.


Article 84 Party members in overseas institutions or temporary overseas delegations (groups) who leave the organization for less than six months and return automatically shall be subject to revocation of their party positions or probation within the party; Those who leave the organization for more than six months will be treated as leaving the party on their own and expelled from the party.


Those who intentionally provide convenient conditions for others to leave the organization shall be given a warning, serious warning, or revocation of their party positions.


Chapter 8 Punishment for violations of integrity and discipline


Article 85 Party members and cadres must correctly exercise the power entrusted by the people, be honest and upright, and oppose any abuse of power or pursuit of personal gain.


If someone uses their power or influence in their position to seek benefits for others, and their spouse, children, relatives, or other specific related persons accept property from the other party, and the circumstances are serious, they shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 86 Those who mutually use their power or influence in their positions to seek benefits for the other party and their spouses, children and their relatives, close staff, and other specific related parties in power transactions shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 87 Those who condone or tacitly allow their spouses, children, their spouses and other relatives, close staff, and other specific related persons to use the power or influence of party members and cadres to seek personal gain, and the circumstances are relatively minor, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the party。


If the spouses, children, and other relatives of party members and cadres, as well as other specific related persons, do not actually work and receive salaries, or if they actually work but receive salaries significantly exceeding the standard for the same rank, and party members and cadres are aware of this and fail to correct it, they shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 88 Those who accept gifts, cash gifts, consumer cards, securities, equity, other financial products, and other property that may affect the fair performance of official duties, and the circumstances are relatively minor, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who accept other clearly excessive gifts beyond normal reciprocity shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 89  Those who give gifts, cash gifts, consumer cards, securities, equity, other financial products and other property that clearly exceed normal reciprocity to personnel engaged in public affairs, their spouses, children, their spouses and other relatives, and other specific related persons, and the circumstances are more serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 90 Those who borrow money, housing, vehicles, etc. from management and service objects, which affects the fair performance of official duties, and the circumstances are serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Those who obtain large returns through financial activities such as private lending and affect the fair execution of official duties shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 91 Those who use their authority or position to handle wedding, funeral, and festive matters, causing adverse effects in society, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions; Those who take advantage of the opportunity to accumulate wealth or engage in other acts that infringe upon the interests of the state, collectives, and the people shall be subject to severe or aggravated punishment, up to and including expulsion from the Party.


Article 92 Those who accept or provide arrangements for banquets, tourism, fitness, entertainment and other activities that may affect the fair performance of official duties, and the circumstances are more serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 93 Those who violate relevant regulations by obtaining, holding, or actually using various consumption cards such as sports and fitness cards, club and club membership cards, golf cards, etc., or violate relevant regulations by entering and leaving private clubs, and the circumstances are relatively serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 94 Those who engage in profit-making activities in violation of relevant regulations and commit any of the following acts, if the circumstances are relatively minor, shall be given a warning or a serious warning; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Engaging in business and establishing enterprises;


(2) Owning shares or securities of non listed companies (enterprises);


(3) Buying and selling stocks or engaging in other securities investments;


(4) Engaging in paid intermediary activities;


(5) Registering a company or investing in shares abroad;


(6) Engaging in profit-making activities in violation of relevant regulations.


Those who use the information obtained during the decision-making and approval process of participating in enterprise restructuring, targeted issuance, merger and investment, land use right transfer, etc. to buy and sell stocks, and use their power or position influence to make abnormal profits through purchasing trust products, funds, etc., shall be dealt with in accordance with the provisions of the preceding paragraph.


Those who violate relevant regulations by taking part-time jobs in economic organizations, social organizations, or other units, or those who have been approved to take part-time jobs but receive additional benefits such as salary, bonuses, allowances, etc., shall be dealt with in accordance with the provisions of the first paragraph.


Article 95 Those who use their power or influence in their positions to seek benefits for their spouses, children, and their relatives and other specific related parties in areas such as approval and supervision, resource development, financial credit, bulk procurement, land use rights transfer, real estate development, engineering bidding, and public finance expenditures, and the circumstances are relatively minor, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who use their power or influence in their positions to provide assistance and seek benefits for their spouses, children, their spouses and other relatives, and other specific related persons by absorbing deposits, promoting financial products, etc., shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 96 Party members and leading cadres who, after resigning or retiring, violate relevant regulations by accepting employment from enterprises and intermediary institutions within the jurisdiction of their original positions and business scope, or engaging in profit-making activities related to their original positions and business scope, shall be given a warning or a serious warning if the circumstances are relatively minor; For those with serious circumstances, they shall be given the punishment of revoking their party positions; Those with serious circumstances shall be given the punishment of staying in the party for probation.


If a leading Party cadre, after leaving office or retiring, violates relevant regulations by holding positions such as independent director or independent supervisor in a listed company or a fund management company, he or she shall, if the circumstances are relatively minor, be given a warning or a severe warning; if the circumstances are relatively serious, be dismissed from his or her Party posts; and if the circumstances are serious, be placed under probation within the Party.


Article 97 If the spouse, children, and their spouses of a Party member or leading cadre violate relevant regulations by engaging in business activities that may affect their fair performance of official duties in the area and business scope under the jurisdiction of the Party member or leading cadre, or holding senior positions appointed or hired by foreign parties in foreign-owned enterprises or Sino foreign joint ventures within the area and business scope under the jurisdiction of the Party member or leading cadre, or illegally holding positions or taking part-time jobs for remuneration, the Party member or leading cadre shall be corrected in accordance with regulations; Those who refuse to correct shall resign from their current position or have their position adjusted by the organization; Those who refuse to resign from their current positions or refuse to comply with organizational adjustments shall be subject to disciplinary action of revoking their party positions.


Article 98 If the Party and state organs violate relevant regulations by conducting business or establishing enterprises, the directly responsible persons and leaders shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Article 99 Party members and leading cadres who violate the work and life security system and seek special treatment for themselves, their spouses, children, their spouses and other relatives and other specific related persons in transportation, medical care, security and other aspects, if the circumstances are serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 100 Those who infringe upon the interests of the state and the collective in the allocation and purchase of housing, and the circumstances are relatively minor, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 101 Those who use their power or influence in their position to embezzle public or private property that is not under their management, or embezzle public or private property by symbolically paying money or other means, or accept services or use labor services without compensation or symbolically paying remuneration, and the circumstances are relatively minor, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


If the individual, spouse, children, and their spouses and other relatives use their power or influence to pay or reimburse expenses that should be paid by themselves, their spouses, and other relatives, they shall be handled in accordance with the provisions of the preceding paragraph.


Article 102 Those who use their authority or position to occupy public property for personal use in violation of relevant regulations for more than six months, and the circumstances are more serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Those who occupy public property for profit-making activities shall be given a warning or a serious warning; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who lend public property to others for profit-making activities shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 103 Those who violate relevant regulations by organizing or participating in banquets, high consumption entertainment, fitness activities paid with public funds, or using public funds to purchase or distribute gifts, consumption cards (vouchers), etc., shall be given a warning or a serious warning for those who are directly responsible and leaders, if the circumstances are relatively minor; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 104 Those who violate relevant regulations by setting their own salary or issuing excessive allowances, subsidies, bonuses, etc., shall be given a warning or serious warning punishment for those directly responsible and leaders responsible, if the circumstances are relatively minor; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 105 For any of the following behaviors, the direct responsible person and the leader responsible person, if the circumstances are relatively minor, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Public funded tourism or tourism disguised as public funds for learning, training, investigation, and employee recuperation;


(2) Changing official schedules and taking advantage of travel opportunities;


(3) Participate in inspection activities organized by managed enterprises and subordinate units, and take the opportunity to travel.


Those who use public funds to travel abroad (overseas) under the guise of inspection, learning, training, discussion, investment promotion, exhibition, etc. shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 106 Those who violate the regulations on official reception management, exceed the standard or scope of reception, or take advantage of the situation to eat and drink excessively, shall be given a warning or serious warning punishment for those who are directly responsible and leaders responsible, and the circumstances are relatively serious; Those with serious circumstances shall be subject to revocation of their party positions.


Article 107 Those who violate relevant regulations by equipping, purchasing, replacing, decorating, or using official transportation vehicles, or engage in other behaviors that violate the management regulations of official transportation vehicles, shall be given a warning or serious warning punishment for those who are directly responsible and those who are responsible for leadership, if the circumstances are serious; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 108  Those who violate the regulations on conference activity management and engage in any of the following behaviors shall be given a warning or serious warning punishment for those who are directly responsible and those who are responsible for leadership, if the circumstances are serious; Those with serious circumstances shall be subject to revocation of their party positions:


(1) Meeting in scenic spots where meetings are prohibited;


(2) Deciding or approving the holding of various festivals and celebrations.


Those who hold evaluation and recognition activities without authorization or charge fees through evaluation and recognition activities shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 109 Those who violate regulations on office space management and engage in any of the following behaviors shall be given a warning or serious warning punishment for those who are directly responsible and those who are responsible for leadership. If the circumstances are more serious, a warning or serious warning punishment shall be given; Those with serious circumstances shall be subject to revocation of their party positions:


(1) Deciding or approving the construction or renovation of office buildings, training centers, and other public facilities;


(2) Providing and using office space beyond the standard;


(3) Renting or occupying guest rooms or other places with public funds for personal use.


Article 110 Those who engage in power sex transactions or give property for money sex transactions shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 111 Those who violate the rules of integrity and discipline shall be given a warning or expelled from the party depending on the specific circumstances.


Chapter 9  Punishment for violations of public discipline


Article 112 For any of the following behaviors, the direct responsible person and the leader responsible person, if the circumstances are relatively minor, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Raising funds and labor from the masses beyond the standard and scope, distributing expenses, and increasing the burden on the masses;


(2) Those who violate relevant regulations by withholding, confiscating money and property from the masses or punishing the masses;


(3) Deducting public property or violating relevant regulations by withholding money from the public;


(4) Charging fees in violation of relevant regulations during management and service activities;


(5) When dealing with matters involving the masses, those who make things difficult for the masses and take advantage of them;


(6) Other behaviors that infringe upon the interests of the masses.


Those who engage in the above-mentioned behaviors in the field of poverty alleviation shall be subject to severe or aggravated punishment.


Article 113 Those who interfere with the autonomy of production and operation, resulting in significant losses to the property of the masses, shall be given a warning or serious warning to the directly responsible persons and leaders; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 114 Those who show favoritism and obvious unfairness in social security, policy support, poverty alleviation, and distribution of disaster relief funds and supplies shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 115 Those who use clans or black and evil forces to oppress the masses, or condone activities related to black and evil, or act as a "protective umbrella" for black and evil forces, shall be subject to revocation of party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 115 If any of the following behaviors are committed, the directly responsible person and the leader responsible person, and the circumstances are more serious, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party:


(1) Those who fail to solve problems related to the vital interests of the masses in accordance with policies or relevant regulations in a timely manner, are lazy and inefficient, and cause adverse effects;


(2) Those who passively respond to the demands of the masses that comply with policies, shirk responsibilities, and engage in buck passing, which damages the relationship between the Party and the masses and the cadres and the masses;


(3) Those who have a bad and crude attitude towards the masses, causing adverse effects;


(4) Falsifying, deceiving superiors and concealing subordinates, and harming the interests of the masses;


(5) Other acts that harm the interests of the masses, such as inaction and disorderly behavior.


Article 117 Those who blindly borrow money, set up stalls, and undertake projects, engage in "image projects" and "performance projects" that cause great losses to the property and interests of the country, collectives, or the masses, shall be given a warning or serious warning to the directly responsible persons and leaders; Those with serious circumstances shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 118 When facing serious threats to national property and the lives and property of the masses, those who are able to save but fail to do so, and the circumstances are more serious, shall be given a warning, a serious warning, or revocation of their party positions and disciplinary actions; Those with serious circumstances shall be given disciplinary measures such as probation or expulsion from the Party.


Article 119 Those who fail to disclose party affairs, government affairs, factory affairs, village (residential) affairs, etc. in accordance with regulations, and infringe upon the right to know of the masses, shall be given a warning or serious warning punishment for those who are directly responsible and those who are responsible for leadership, if the circumstances are serious; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Article 120  If there are other violations of public discipline regulations, a warning or even expulsion from the party shall be given depending on the specific circumstances.


Chapter 10 Disciplinary action against violations of work discipline


Article 121  Those who are irresponsible or neglectful in their work, fail to implement, inspect and supervise the implementation of superior decisions and deployments, and cause significant losses to the interests of the Party, the country, the people, and public property, shall be given a warning or serious warning to the directly responsible persons and leaders; Those who cause significant losses shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Those who fail to implement the development concepts of innovation, coordination, green, openness, and sharing, and neglect or fail to take responsibility for issues within their scope of duties, resulting in significant or substantial losses, shall be subject to severe or aggravated punishment.


Article 122 Any of the following behaviors that cause serious adverse effects shall be given a warning or serious warning to the directly responsible person and the leader responsible person, if the circumstances are relatively minor; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Those who only express their opinions without implementing the decisions and deployments of the Party Central Committee;


(2) Passionate about creating public opinion and floating on the surface;


(3) Simply implementing meetings and documents without taking action in actual work;


(4) There are other formalistic and bureaucratic behaviors in work.


Article 123 If a party organization commits any of the following acts, the directly responsible person and the leader responsible person, if the circumstances are serious, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party:


(1) Party members who have been sentenced to criminal penalties in accordance with the law but have not been given disciplinary action according to regulations, or who should have been given disciplinary action but have not been punished for violating national laws and regulations;


(2) After the decision on disciplinary action or appeal review is made, failure to implement the provisions of the decision regarding the party membership, position, rank, and treatment of the punished person in accordance with regulations;


(3) Party members who, after being disciplined by the Party, fail to carry out daily education, management, and supervision of the disciplined Party members in accordance with their cadre management authority and organizational relationships.


Article 124 If the personnel under management defect due to irresponsible work, the direct responsible person and the leader responsible person shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


If the personnel under management leave due to irresponsible work, the direct responsible person and the leader responsible person, if the circumstances are serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Article 125 Those who fail to report or report truthfully on matters that should be reported during inspections or reporting to superiors, resulting in serious damage or serious adverse effects, shall be given a warning or serious warning to the directly responsible persons and leaders; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party.


Those who condone, incite, imply, or force subordinates to tell lies or report false information during inspections or reporting to superiors shall be given heavier or more severe punishment.


Article 126 Party members and leading cadres who violate relevant regulations by intervening and interfering in market economic activities, and engage in any of the following behaviors, causing adverse effects, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party:


(1) Intervention and involvement in construction project contracting, land use rights transfer, government procurement, real estate development and operation, mineral resource development and utilization, intermediary agency services, and other activities;


(2) Intervening and intervening in the restructuring, merger, bankruptcy, property rights trading, asset appraisal, asset transfer, major project investment, and other major business activities of state-owned enterprises;


(3) Intervening and interfering in the approval of various administrative licenses and fund loans;


(4) Intervention and involvement in economic disputes;


(5) Intervention and interference in the use, allocation, contracting, leasing, and other matters of collective funds, assets, and resources.


Article 127 Party members and leading cadres who violate relevant regulations by intervening and interfering in judicial activities, disciplinary and law enforcement activities, inquire about the case, greet or plead with relevant localities or departments, or exert influence on judicial activities, disciplinary and law enforcement activities in other ways, and the circumstances are relatively minor, shall be given a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Party members and leading cadres who violate relevant regulations by intervening and interfering in activities such as public finance fund allocation, project approval review, government rewards and commendations, causing significant losses or adverse effects, shall be dealt with in accordance with the provisions of the preceding paragraph.


Article 128 Those who leak, spread, inquire about, or steal Party organizations' undisclosed matters such as cadre selection and appointment, disciplinary review, inspection and patrol, or other confidential content shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who privately retain materials related to the selection and appointment of cadres, disciplinary review, inspection and patrol by party organizations, and the circumstances are serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Article 129 Those who violate relevant regulations such as leaking test questions, cheating in the examination room, altering exam papers, and violating admission rules during the examination and admission process shall be given a warning or a serious warning; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 130 Those who seek to use public funds to travel abroad or abroad in an improper manner, and the circumstances are relatively minor, shall be given a warning punishment; Those with serious circumstances shall be given a serious warning; Those with serious circumstances shall be subject to revocation of their party positions.


Article 131 Party members in temporary overseas (border) delegations (groups) or among temporary overseas (border) personnel who, without authorization, extend their stay abroad (overseas) or change their itinerary shall, for the persons directly responsible and the leading persons responsible, be given a warning or a severe warning; if the circumstances are serious, they shall be dismissed from their Party posts.


Article 132 Party members in overseas institutions or temporary overseas delegations (groups) who violate the laws and regulations of the host country or region, or do not respect the religious customs of the host country or region, and the circumstances are serious, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to disciplinary actions such as revocation of party positions, probation within the party, or expulsion from the party.


Article 133 Those who fail to perform or improperly perform their duties in the Party's disciplinary inspection, organization, propaganda, united front work, and other organizational work, resulting in losses or adverse effects, shall be given a warning or expelled from the Party depending on the specific circumstances.


Chapter 11 Punishment for violations of life discipline


Article 134 Those who live extravagantly, indulge in pleasure, and pursue low-level pleasures, causing adverse effects, shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Article 135 Those who engage in improper sexual relations with others and cause adverse effects shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Those who engage in sexual relations with others using their authority, upbringing, subordination, or other similar relationships shall be subject to severe punishment.


Article 136 Party members and leading cadres who do not attach importance to family ethics construction, neglect their spouses, children, and their spouses, and cause adverse effects or serious consequences, shall be given a warning or a serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions.


Article 137 Those who violate social order and good customs, engage in inappropriate behavior in public places, and cause adverse effects shall be given a warning or serious warning punishment; Those with serious circumstances shall be subject to revocation of their party positions or probation within the party; Those with serious circumstances shall be expelled from the Party.


Article 138 Those who engage in other serious violations of social ethics and family virtues shall be given a warning or even expelled from the Party depending on the specific circumstances.


Part 3  supplementary articles


Article 139  The party committees of each province, autonomous region, and municipality directly under the central government may formulate individual implementation regulations in accordance with this regulation and based on their respective work situations.


Article 140 The Central Military Commission may, in accordance with these Regulations and in the light of the actual situation of the Chinese People's Liberation Army and the Chinese People's Armed Police Force, formulate supplementary or individual provisions.


Article 141 This regulation is interpreted by the Central Commission for Discipline Inspection.


Article 142 This regulation shall come into effect on October 1, 2018.


Before the implementation of this regulation, if closed cases need to be reviewed and reconsidered, the regulations or policies at that time shall apply. For unresolved cases, if the regulations or policies at the time of the behavior do not consider it a violation of discipline, but this regulation considers it a violation of discipline, it shall be handled in accordance with the regulations or policies at that time; If the regulations or policies at the time of the behavior consider it a violation of discipline, it shall be dealt with in accordance with the regulations or policies at that time. However, if this regulation does not consider it a violation of discipline or the punishment is relatively light, it shall be dealt with in accordance with the provisions of this regulation.
